Subject: Privacy at the workplace: fairy tale or threat?
 
In the old days, everything was simple: when an employee was at the workplace, the boss was simply the boss. It was unthinkable that an employee would have some sort of private life or protection of personal privacy at the workplace. Today, after a series of international treaties on human rights, European Charters and local legislation, things are not that straightforward any more. Although some believe it is perfectly normal for employers to check and monitor their employees at the workplace to know what they are doing (it is the employer’s money and time, after all) and sometimes outside the workplace (e.g. candidate employees), others believe that the fundamental rights of employees, including their right to privacy, cannot be infringed – not even at the workplace.    
 
Moreover, nowadays all sorts of technical devices, including possibilities offered by new electronic communication devices, allow for more and different ways of checking and monitoring employees. Just think of pre-employment screening, monitoring and checks on the work floor (camera surveillance, (body)-search/baggage checks, checks on use of drugs and alcohol in the workplace), monitoring of the use of computer infrastructure (hard disks of computers, computer network, Internet) and monitoring of communication (correspondence, phone conversations, e-mail, etc.).
 
How do those monitoring techniques relate to the individual and fundamental right of employees to respect for their private life? How far can an employer go? Which monitoring techniques are lawful? How should these techniques be implemented? What happens if the employer infringes an employee’s privacy rights? Can the employer use evidence gathered by means of unlawful monitoring techniques?
 
Leen Cornil and Benjamin Gillard will answer these questions from the viewpoint of employment law and criminal law. Their presentation will cover topics such as: employee and candidate screening by means of social media; monitoring of employees’ use of social media during working hours, monitoring of telecommunication use during work hours, camera surveillance, drug and alcohol control, internal hacking and exit controls.

Social Media: What? Why? When?
We are living in the computer assisted age of making and maintaining relationships.  As HR is a key player in the "relationship" business this media can't be ignored as part of our business strategy.  However, to use these tools effectively both personally and professionally, we need to know what tools are out there.  What is the focus of each? How are they currently being used? What are the advantages/disadvantages for using them in the HR environment? 

 

 In the HR environment, we often look at "relationships" from the perspective of "engagement".  Engagement itself can refer to recruitment, employee motivation and customer loyalty.  Therefore, the session will look at social media in these three contexts.


Our speaker, David Demetrius, is co-founder and partner in Fyronic, which focuses on innovation, business agility and collective intelligence to help clients leverage the power of Social Media, Web 2.0 and Enterprise 2.0 concepts and technologies to create business value.  He brings practical experiences of his use of social media in his current and previous businesses.

Harassment at the workplace,

about use and abuse of the harassment legislation and

about the role and liabilities of the employer and the HR manager.

The Act of 11 juni 2002, modified in 2007 on violence, and on moral and sexual harassment at the work place implemented a series of European Directives into Belgian law with the purpose of protecting employees from being harassed by their employer, their colleagues or third parties.  Today those anti-harassment rules have become a major part of the set of laws and rules on wellbeing at the work place.  

However all these laws and rules have not been able to prevent that in some companies horror stories about harassments are coming up in the media.  At the same time employers have been complaining that the anti-harassment laws are giving a set of protective tools to some workers that just want to create some extra protection for themselves.   

As the legislation on violence, harassment and sexual harassment on the work floor will have its 10th birthday next year in 2012, it seems that time has come to make the point. 

Véronique Pertry will cover topics such as the present status of the law with a recap of the principles and procedures, important case law on harassment, weak points that leave room for abuse, and the role and liabilities of the employer and the HR manager as seen in the case law.

A recent study by Aon Hewitt found that more than half of Belgians expect to have to postpone the age of retirement because of the current economic climate. Yet more than half of Belgian workers want to retire before age 65 and would prefer  to earn less by opting for early retirement.

News on this matter is that Belgian pensions will soon be insufficient or unaffordable. Complementary pensions can they still bring relief? To know more about this subject of general interest, please register to this event straight away.
